1. Installation

1.1 Installation - Single-User Version

(1)The Dynamic will send a technical staff to install the Program onto the hard disk of one PC.

1.2 Installation - Network Version

(1)The User will be responsible for the installation of the network system, which will work properly and print properly under the operating system;

(2)The User will be responsible for the definition of user rights in the network;

(3)The Dynamic will send a technical staff to install the Program onto the server of the network system and to prepare a number of batch files for logging into the Program. The number of batch files will be equal to the number of network users purchased for Dynamic Accounting System.

1.3 Changes in configurations after installation

(1)After successful installation, the Dynamic will not be responsible for changes in the User's facilities or the configurations thereof that affect the proper functioning of the Program.

1.4 Location

(1)On-site installation service is restricted to premises located in commercial and industrial areas in Hong Kong, Kowloon or the New Territories.

2. Training Course

2.1 Training Classes

(1)The Dynamic will conduct regular classes on the Program. The User may enroll by presenting coupons or by paying fees. Such classes will be held at the Dynamic.

(2) The medium of instruction is Cantonese.

2.2 Repetition of Training

(1)Within the service or maintenance period, the course attendants are entitled to an unlimited number of repetition of the training course.

2.3 Reservations

(1)Course attendants who have reserved seats but fail to present themselves on the training days will be put on the waiting list for future classes.

3. Consultation

3.1 Scope of Consultation

(1)The User may seek assistance on specific problems related to the use of the Program by telephone. Such User should have already acquired knowledge of the Program, by attending the training course, by reading manuals or by following the worked examples.

3.2 Data Setup

(1)The User may fax plans about data setup to consultants of the Dynamic, who will study and respond to the User. The User may also make appointments with consultants of the Dynamic to discuss such plans in detail. Such meetings will be held at the Dynamic.

4. Data Maintenance

4.1 Responsibilities of the User

(1)The User is responsible for the proper maintenance of the hardware and other computer facilities with which the Program operates.

4.2 Responsibilities of the Dynamic

(1) In the events of data inaccuracy or data corruption, the User may send the data backup, in the form of floppy diskettes or zip diskettes to the Dynamic whose consultants will study and produce a report and, if feasible, fix any errors that have been found.

4.3 Improper access to data

(1)The User shall not modify the accounting data in any ways other than through the Program. In the case the User does so, the Dynamic will not bear any further responsibilities towards the maintenance of the data of the User.

5. Exclusion of Liability

5.1 Exclusion of Liability

(1)The User agrees not to claim the Dynamic for any loss arising from the faults or negligence of the staff or agent of the Dynamic in the course of providing services to the User. The Dynamic shall be under no liability whatsoever for any direct or indirect loss (including loss of profit) and/or expenses suffered by the User or liability to third parties incurred by the User.
